SPECIAL STATEMENT OF PROSECUTOR GENERAL, MINISTRIES OF NATIONAL SECURITY AND INTERNAL AFFAIRS OF AZERBAIJAN REPUBLIC

Recently, in particular, before the parliamentary elections appointed to November 6, 2005, are observed attempts of aggravation under the mask of appeal to democratic changes of the political situation in the country, expedient management of the said processes in the purposeful form, which have hostile character.

The received messages testify that accused in plunder of large financial assets, commitment of crimes against public interests, Rasul Guliyev, declared by court in the international search with preventive punishment of imprisonment, with a view of evasion from justice and coming to power by unconstitutional way, expecting on support of some supporters in the country and the certain destructive forces, became more active before parliamentary elections, has resorted to the next criminal actions.

It has been established that Rasul Guliyev has given to his supporters the task on involving in this cause of broad masses of the population not to allow his arrest, to establishment of links with the persons interested in displacement of power, and use of their financial opportunities, to carrying out of special work down to armed resistance.

Due to carried out preventive and decisive measures by law enforcement bodies the abovementioned illegal acts were prevented.

It has been established that according to the preliminary plan, intensive and long appeals sounded that on October 17 this year to collect people in the mass order at the Heydar Aliyev International Airport and on adjoining territories, wide propaganda activities have been carried out. The serious work on creation of separate provocative groups for realization of illegal actions, maintenance with weapon, to undermine the situation from under the control of the state structures, has simultaneously been done attacks on forces of protection of social order and creation of disorders, and finally - to violent capture of power. To this end, on routes of movement of the population and places of its possible congestion, has been hidden a plenty of weapon, ammunition and explosives.

On October 17, 2005, adherents of Rasul Guliyev have made attack on the police posts created on roads, leading to the airport, with a view of safety in the city of Baku to break through barrier of police, made on police physical injuries of various degree. As a result of the accepted measures, all attempts directed on creation of confrontation, disorders and violent capture of power, the acts representing threat for public safety, have been stopped in the order established by the legislation. Besides, in various territories of capital, the weapon, ammunition and explosives have been found out and withdrawn.

At the same time, during prevention of illegal actions, it has been established that by the coordinating person responsible for allocation of large financial assets with a view of violent capture of power, distribution to their forces which will be involved in disorders, former Minister of Finance of Azerbaijan Fikret Yusifov who on October 16 has been detained as the suspected, was arrested on appropriate decision of court. During the search, which has been carried out on apartment of Fikret Yusifov in connection with investigation of criminal case, 100.000 Euros and 60.000 US dollars have been withdrawn.

Watching closely occurring processes, Rasul Guliyev, seeing, that for a meeting of him broad masses of the population have not gathered, that authorities resolutely stopped illegal acts of his supporters, that the plans of violent capture of power have failed, has refused to arrive in Baku.

On October 18, 2005, Fikret Yusifov, having addressed with the statement to the general public prosecutor of the Azerbaijan Republic, has expressed desire to give voluntary indications about preparation which Rasul Guliyev and his supporters carried out for violent capture of power in Azerbaijan.

In his testimony, Fikret Yusifov pointed that in July 2005 during his visit to the city of St. Petersburg of the Russian Federation, Rasul Guliyev with whom he had close links earlier, made him a call by mobile phone and asked to convey his instructions on financing the process of the capture of power to the minister of economic development of the Azerbaijan Republic Farhad Aliyev and other adherents with financial opportunities.

To this end, Fikret Yusifov in August current year has met with Farhad Aliyev and his brother Rafig Aliyev in the latter’s office and conveyed Rasul Guliyev’s assignments. Farhad Aliyev promised all-round assistance in this question and in his turn promised extra measures through his own links. Late August, Fikret Yusifov went back to St. Petersburg and through telephone passed on Farhad Aliyev’s consent to Rasul Guliyev.

On the next assignment of Rasul Guliyev, he, on September 23 coming back to Baku has met at the same office with Farhad Aliyev and the latter stated his readiness to render any assistance, at the same time, allot 3 million dollars and organize all that depend on him.

On October 3, 2005, Fikret Yusifov has met with Rasul Guliyev in the city of Berlin. In these meeting, stating that he will return to Baku in mid-October current year, Rasul Gliyev stressed the necessity of welcoming him by mass of people, prevent to arrest him, by causing mass unrest assume power. To arrange all this, Rasul Guliyev gave instruction to make certain real financial assistance.

Being back to Baku, Fikret Yusifov has met with Farhad Aliyev and conveyed the instructions to the latter. On October 15, Farhad Aliyev personally handed over 100 thousand Euros to Fikret Yusifov to finance capture of power. The money, on October 16, 2005, was taken as evidence during search in Fikret Yusifov’s apartment.

As a result of operative measures, also it has been established that Farhad Aliyev, abusing official powers, has admitted hard infringements of the law during privatization of the state property, having documented the state property under the low prices, has issued them on names of his relatives, actually, having transferred in his property.

Now, in numerous commercial objects belonging to Farhad Aliyev, including the “AZPETROL” Company, the investigation connected to infringement of the law was launched. The owner of “AZPETROL” Company Rafig Aliyev has been detained at the airport at attempt to leave the country.

On the basis of the collected materials and decision of the Prosecutor General of the Azerbaijan Republic on October 18, 2005, on the fact, had been launched criminal case under Articles 179.3 (misappropriation and squandering), 308.2 (abusing official powers), 28, 220 (attempt for unrest), 278 (violent capture of power) of the Criminal Code of the Azerbaijan Republic, and on October 19, 2005, Farhad Aliyev has been detained as the suspected on the case.

Now, investigation-operative group of employees of the Prosecutor General, the ministries of national security and internal affairs, the necessary investigation actions directed on all circumstances of the case are underway.
