Law of the Republic of Azerbaijan On identification card of citizen of the Republic of Azerbaijan
Article 1. Identification card of citizen of the Republic of Azerbaijan
Identification card of citizen of the Republic of Azerbaijan (hereinafter referred to as identification card) is a document verifying the identity of citizen of the Republic of Azerbaijan on the territory of the Republic of Azerbaijan.
If an international treaty has been signed with foreign countries, the identification card may also be used as a document verifying the identity of a citizen in those countries and for exercising his/her right to leave and enter the country.
Every citizen of the Republic of Azerbaijan who has reached the age of 15 years or a person after receiving the citizenship of the Republic of Azerbaijan must receive an identity card within one month. A citizen of the Republic of Azerbaijan who has not reached the age of 15 is entitled to receive an identity card on the basis of an application of his parents, a citizen's adoptive parent, a guardian or trustee of a citizen (hereinafter referred to as a legal representative), as well as a person appointed on the basis of a notarized power of attorney of a legal representative.
Every citizen or legal representative of the holder of the identity card shall carefully keep the identification card.
Refusal to issue or replace the identification card, its confiscation in contradiction with rules set under this Law is absolutely prohibited. In loss of the identification card, its holder or legal representative of the holder of the identity card shall immediately inform the issuing authority.
Article 2. Types of identification card
identification card can be of following types:
1) identification card issued to citizen before the age of 16;
2) identification card issued to citizen reaching the age of 16.
Draft blanks of types of identification cards are approved by the Supreme Soviet of the Republic of Azerbaijan .
Article 3. Information contained in identification card
The citizen's surname, name, patronymic, gender, date of birth, place of birth, blood group, personal identification number, card number and the period of validity, as well as personal signature of the ID card holder and a photo according to requirements of the International Civil Aviation Organization (ICAO) are entered in the identity card.
- the information provided in the first part of this article;
- his/her previous surname and (or) name if the citizen has changed his/her surname and (or) name;
- citizen's birthplace, place of residence, marital status, height, color of eyes, fingerprints, military duty of the citizen;
- surnames, names, patronymics of the citizen's parents, surname, name, patronymic of the citizen's legal representative and their contact details (postal address, telephone numbers);
- surname and name of the husband (wife) of the citizen (if the surname changed when entering the marriage, the pre-marriage surname is also indicated);
- the surname and the name of the citizen's children;
- at the request of the citizen - certificates related to his/her enhanced electronic signature, data for creating and verifying an electronic signature, assigned by an accredited certification services center (signature generation information is closed for reading);
- the name of the issuing authority and the date of issuance of the certificate;
- other information provided for in the "Regulation on the Application of the Law of the Republic of Azerbaijan "On Identity Card of the Citizen of the Republic of Azerbaijan".
The official entering the information provided in this Article in the identity card or electronic medium of the card, is responsible for its accuracy.
Article 4. Issuance of the identity card
An identity card is issued by the relevant executive authority on the basis of an application of a citizen of the Republic of Azerbaijan or his legal representative, as well as a person appointed on the basis of a notarized power of attorney of his legal representative, and other documents provided for by the "Regulations on the application of the Law of the Republic of Azerbaijan "On identity card of the citizen of the Republic of Azerbaijan”, approved by the relevant executive authority, no later than 10 days from the date of application of the citizen or his legal representative, as well as the person appointed on the basis of a notarized power of attorney of his legal representative. An identity card is issued for a ten-year period, and for persons over 55 years of age - for an indefinite period. An identity card issued to a citizen who has not reached the age of 5 is valid until he reaches the age of 5, and an identity card issued to a citizen who has reached the age of 5 is valid until he reaches the age of 15.
Upon expiration of the validity of the identity card, either by changing the name, surname, patronymic of the citizen or damage to the identity card, including its electronic medium (chip), or when identifying unreliable data on the identity card, it should be replaced.
After the occurrence of one of the circumstances specified in the second part of this article, in order to replace the identity card, a citizen or his legal representative within one month must personally or through a person appointed on the basis of a notarized power of attorney of the legal representative of a citizen, apply to the body that issued the certificate.
The issuance or replacement of an identity card to a citizen under the age of 15 is carried out on the basis of an application from his legal representative, as well as a person appointed on the basis of a notarized power of attorney of a legal representative, and other documents provided for by the "Regulation on the application of the Law of the Republic of Azerbaijan" On the identity card of a citizen of the Republic of Azerbaijan”, approved by the relevant executive authority.
An identity card issued to a citizen under the age of 15 shall contain his photograph, but his personal signature shall not be indicated.
A citizen under the age of 15 is not fingerprinted, and information about his marital status, height, eye color, military duty and the information specified in the sixth to eighth paragraphs of the second part of the article 3 of this Law is not entered into the electronic data carrier of the identity card issued to him.
The photographic requirements, information about the work schedule of the authority issuing an identity card, the list of documents required for issuing or replacing the certificate, and the amount of state duty payable must be posted on the official website of the relevant executive authority and on a clearly visible shield in front of buildings of local authorities, issuing identity cards.
Note: Identity cards issued before September 1, 2018 remain valid until a citizen reaches 25, 35, 50 years of age or changes in a family name, first name, patronymic, marital status, citizen’s military duty, or loss, damage of identity card or identification of unreliable data on ID.
Article 5. State duty
The amount of state duty for issuing an identity card of a citizen of the Republic of Azerbaijan is established by law.
If an error is detected in the data indicated on the identity card, this certificate is replaced within 1 (one) day from the date of its submission without retaining the state fee. If an error is detected in the data entered in the electronic carrier of the identity card, these data are changed immediately after (no later than 30 minutes) the certificate is submitted to the body that entered the erroneous data, without deducting the state fee.
Article 6. Events of temporary collection of the identification card
In the event of call of citizen to statutory military service, the relevant executive authority, and in the event of the citizen enrolment to military education institution for special purposes, the administration of this institution shall temporarily collect the identification card of the conscript (cadet) and shall send it to relevant executive authority for retention until completion of military service and return to owner.
Prosecution, investigation, court and punishment execution authorities or special teaching and educational institution of a closed type shall temporarily collect the identification card from person against whom the detention, house arrest or bail as measure of restraint was selected, sentenced to custodial restraint, sentenced to custody for the term or life, sent to a special teaching and educational institution of a closed type, and shall be attached to the case against that person or his personal file. Upon termination of such basis the identification card shall be returned to its holder immediately or his/her legal representative, as well as to the person appointed on the basis of a notarized power of attorney of the legal representative.
Article 7. Return and recognition of the identification card invalid
In death of citizen his identification card is submitted to the authority maintaining the state registration of civil status acts, and then sent by this authority to respective executive authority upon registration of the death of citizen.
The found identification card shall be submitted to issuing state authority.
If citizen does not replace the identification card in cases and within term stipulated under Article 4 of this Law, it shall be deemed invalid.
Article 8. Liability for violation of provisions of this Law
Persons found guilty in refusal to issue an identity card, demanding for its issuance from a citizen or his legal representative, as well as a person appointed on the basis of a notarized power of attorney of a legal representative, to submit documents not provided for or delay in issuing (replacing) an identity card, changing data in the electronic carrier of the certificate, in contradiction with provisions of this Law, as well as its loss, deliberate deterioration, theft, illegal production, counterfeiting, sell or illegal use, shall be liable in accordance with procedures stipulated under the legislation of the Republic of Azerbaijan.
Article 9. Transitional Provisions
9.1. Taking into account the fact that the personal identification card of a citizen of the Republic of Azerbaijan who has not reached 15 years of age (hereinafter referred to as a citizen under 15 years of age) will be applied from January 1, 2022, from 1 September 2018 to January 1, 2022 an identity card will also be issued to citizens who are under 15 years of age.
9.2. The issuance or replacement of an identity card to a citizen under 15 years of age is carried out on the basis of an application of his parent, adoptive parent, guardian or curator (hereinafter the legal representative) and other documents provided for by the “Regulation on the application of the Law of the Republic of Azerbaijan”, approved by the relevant executive authority.
9.3. In the identity card issued to a citizen under the age of 15, his photo is placed, but the personal signature is not indicated.
9.4. A citizen under 15 years of age is not fingerprinted and the information about his marital status, height, eye color, conscription and information indicated in the sixth-eighth paragraphs of the second part of the article 3 of this Law is not entered into the electronic medium of the identity card issued to him.
9.5. Identification card issued to a citizen under 5 years will be valid until its 5 years old and identification card issued to a citizen who has reached 5 years until reaching 15 years.
