11.08.2015As previously reported, on the 8th of August, a resident of the city of Baku Aliyev Rasim Mammadali oglu sustained numerous bodily injuries after he was beaten by a group of unknown persons and was hospitalized to the Clinical Medical Center where he deceased on the 9th of August.
The Baku City Prosecutor Office launched a criminal case based on this fact under Article 126.3 of the Criminal Code (intended grievous bodily harm that entailed death of an individual) and an operational investigation group was formed of the prosecutor’s office and police officers.
This high profile grievous crime which was brought under special control of the Head of State was solved within a short period, and suspects were identified and prosecuted.
It was determined during the preliminary investigation that on the 6th of August, Javid Huseynov (born in 1988 in the Jabrayil region) called a newstaper of Ann.tv Rasim Aliyev and demanded publishing a disclaimer from him in respect of critical statements published by the latter at his personal page in Facebook concerning the acts committed by J.Huseynov, a player of f.c. Gabala, during an interview with journalists after the match held between the f.c. Apollon of the Republic of Cyprus and f.c. Gabala in Baku.
Further, Elshan Ismayilov, a J.Huseynov’s cousin (born in 1994 in Baku) also called R.Aliyev and demanded publishing a disclaimer. This incident resulted in a conflict developed between the above mentioned individuals. As a result, seeking vengeance upon R.Aliyev, Elshan Ismayilov formed a group of his friends Jamal Mammadov, Arif Aliyev, Kanan Madatov and Samir Mustafayev and met R.Aliyev near the Bayil Market shop in the Bayil settlement at 04:00 pm on the 8th of August. They caused grievous bodily harm resulted in internal injury of R.Aliyev by hitting blows with arms and legs and fled the scene. R.Aliyev was delivered to the Baku Clinical Medical Center by an emergency ambulance and was operated. However Medical Center professionals failed to save his life and R.Aliyev died at 09:05 am on the 9th of August.
It was determined in the course of investigation that R.Aliyev’s Iphone-6 mobile phone was broken by a criminal participant Arif Aliyev and thrown away near the Arzu wedding restaurant in the Bakikhanov settlement where the latter resides. The mobile phone was detected and withdrawn as physical evidence.
Measures are taken to detect other physical evidences.
E.Ismayilov, S.Mustafayev, J.Mammadov, K.Madatov and A.Aliyev were convicted of the crime provided for in Article 126.3 of the Criminal Code and were remanded in custody by the court.
At the present stage of investigation, in view of reasonable suspicion about the facts of being aware of the crime planned by his cousin E.Ismayilov, failure to report conclusive knowledge of a planned or committed crime as well as not previously promised concealment of the crime, Javid Huseynov was accused under Article 307.1 (failure to report conclusive knowledge of a planned or committed crime) and 307.2 (not previously promised concealment of a grievous crime) of the Criminal Code and was remanded in custody by the court.
The operational investigation group also considers a case of incitement to this crime by J.Huseynov.
The course of investigation and implemented measures are reported to the President of the Republic of Azerbaijan on a regular basis.
