Issue of license for producing seals and stamps of various kind


 

License for producing seals and stamps of various kind is issued by Head Public Security Office of Ministry of Internal Affairs of Azerbaijan Republic.

Applicants produce followings for getting license.

- Application

An application includes name, organizational-structure formation, juridical address, number of settlement account and name of bank, kind of activity of juridical person; name, patronymic, last name, information on identity card (series, number, issued by whom and when, address), kind of activity of natural person. 

The copy of state registration certification of juridical person, copy of document that proves registration of applicant by tax offices, copy of document that proves right of user on the object indicated on application, deed that proves availability of the premise and developed by representatives of polis and fire-prevention offices.

The produced documents are registered on special book and viewed. Decision for issue of license is given at the latest 15 days from the time of registration if no deficiencies and no reason for refusal are marked.

On detection of deficiencies applicant should be informed at the latest 5 days. After removal of deficiencies and producing documents the proper decision is made within 5 days.

In case of refusal applicant should be informed in written form indicating reasons within 5 days.

In case of consent applicant should produce document that proves payment of state duty.

Licenses become invalid on liquidation of juridical person and decease of natural person.

In cases of  reorganization of juridical person, renaming, data changes on natural person’s ID (series, number, issued by whom and when, address), or loss of license applicant should produce documents again for registration within 15 days. During the period of  second registration applicant continues its activity on the basis of previous license, in case of loss on the basis of temporary permission. The temporary permission signed and certified with seal of the Head of HPSO is issued after producing of all documents.

License includes following indices:

  • name of state body issued license;
  • name of juridical person and address;
  • name, patronymic, information on identity card (series, number, issued by whom and when, address);
  • kind of activity permitted by license;
  • period of validity;
  • registration number and date of issue of license;
  • license is signed by the head of HPSO and certified with seal;

When the activity permitted by license is carried out at different places applicant is given copies of licenses for each object indicating their addresses along with license.

License is given for 5 years. Prolongation of the period of validity is carried out by re-legalization of the document confirming the existence of the license. Overdue license is considered invalid.

Head Public Security Office controls the compliance with the terms and conditions of the license by juridical and natural persons. The control on compliance with the terms and conditions of the license by juridical and natural persons is carried out in a form defined by the Ministry of Economic Development of Azerbaijan Republic once a year by presenting the information to HPSO.

HPSO has the following rights in the field of control:

  • To check the compliance with the terms and conditions of the license by juridical and natural persons who got license;
  • To demand necessary explanations and documents from the juridical and natural persons during a control;
  • To draw up an act (protocol) on the basis of the results of control by indicating the violations concretely;
  • To make decision for elimination of the observed defects;
  • To inform juridical and natural persons;

The license may be terminated by the HPSO in the following cases:

  • in case of putting in an application by the license holder;
  • in case of breach of standard acts by the license holder or in case of termination of the applicant’s activity by the respective state bodies;
  • in case of confirmation of bankruptcy of the license holder.
  • In other cases specified by the legislation of Azerbaijan Republic.

The holder of license and regional tax body is informed about the termination of the license in written form within 3 days after the decree made.

License may be restored according to the address after elimination of the cases causing the termination of the license. The license is considered restored after making decision about it and the holder of license and the state regional tax body is informed about it within 3 days.

The license is annulled by the HPSO in the following cases:

  • in case of putting in an application by the license holder;
  • in case of false information in the documents presented for license;
  • in case of appropriate order of the court;
  • in case of liquidation of the juridical person and death of the natural person;
  • In other cases specified by the legislation of Azerbaijan Republic.

The holder of license and state tax bodies are informed about the annulment of the license in written form within 3 days after the decree made.

The register of issued, registered, terminated, restored and annulled licenses is carried out. Regional tax body is informed within 10 days after registration of the license in the register.
